RESOLUTION NO. 26518
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA UPHOLDING THE APPLICANT'S APPEAL AND APPROVING A GENERAL PLAN AMENDMENT OF PROPERTIES LOCATED AT 455 AND 459 YOLANDA AVENUE (FILE NUMBER MNP04-046)
WHEREAS, the Department of Community Development conducted an Initial Study dated September 20, 2005 and rendered an environmental determination that the proposed General Plan Amendment, will not have a significant impact on the environment; and
WHEREAS, on October 27, 2005, the Planning Commission conducted a public hearing in consideration of a General Plan Amendment from Light Industry/Medium High Density Residential to General Industry at 455 and 459 Yolanda Avenue, and
WHEREAS, the Planning Commission found that the expansion of industrial uses is not consistent with plans for residential and commercial development in the area and voted 5-0 to deny the requested General Plan Amendment (Resolution No. 10864, adopted on November 10, 2005); and
WHEREAS, the applicant appealed the decision of the Planning Commission to the Council; and
WHEREAS, the Council conducted an appeal hearing regarding the proposal; and
WHEREAS, the Council finds that approval of a General Plan Amendment from Light Industry/Medium High Density Residential to General Industry at 455 and 459 Yolanda Avenue is warranted for this location because:
(1) The record indicates longstanding City support to allow this business to expand;
(2) The General Plan encourages allowing existing businesses to expand if it can be done in a manner that is compatible with the surrounding neighbors; and,
(3) The General Plan Amendment will allow the applicant to improve the area in terms of safety and aesthetics, which will be a benefit to the neighborhood.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa upholds the appeal and approves of a General Plan Amendment at 455 and 459 Yolanda Avenue, Assessors Parcel Numbers 044-071-009, 044-041-093 and 044-041-095, which would amend the land use designation from Medium High Density Residential/Light Industry to General Industry.
