RESOLUTION NO. 24081

RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING A CONTRACT AMENDMENT WITH CARLILE -MACY INC. FOR THE PREPARATION OF CONSTRUCTION DRAWINGS, AND A NEPA DOCUMENT FOR THE PRINCE MEMORIAL GREENWAY AND SETTING ASIDE A DESIGN CONTINGENCY

WHEREAS, citizens of the City of Santa Rosa have stated to the Council that establishing a multiple-use greenway along Santa Rosa Creek would result in the betterment of the City; and

WHEREAS, the Council approved and adopted the Santa Rosa Creek Master Plan and E.I.R. in which goals and objectives call for a greenway along Santa Rosa Creek, part of which is from Santa Rosa Avenue to Railroad Street; and

WHEREAS, on August 12, 1997, the Council approved a Conceptual Design Plan prepared by Carlile, Macy, Mitchell, and Heryford, which design plan calls for the restoration and trail development from Santa Rosa Avenue to Railroad Street; and

WHEREAS, on September 9,1997, the Council approved a contract with Carlile, Macy, Mitchell and Heryford, for the preparation of construction drawings for the Prince Memorial Greenway from Santa Rosa Avenue to Railroad Street; and

WHEREAS, due to changes not contained in the original contract necessitated by the hydraulic capacity of the creek identified by the Sonoma County Water Agency and Resource Management Conservation Agency (formerly Soils Conservation Service), an amendment of the contract is needed.

NOW THEREFORE BE IT RESOLVED that based upon the materials and evidence presented, the Council of the City of Santa Rosa finds and determines that the amendment of the contract with Carlile-Macy Inc. for the preparation of construction drawings, incorporating changes due to hydraulic needs, and a NEPA document will be consistent with the City's General Plan, Santa Rosa Creek Master Plan, and the Prince Memorial Greenway Concept Plan and will promote the health safety and general welfare of the community.

BE IT FURTHER RESOLVED that the Council approves and authorizes the Mayor to execute a contract amendment with Carlile-Macy Inc. for the completion of construction drawings for the Prince Memorial Greenway and a NEPA document. The cost of the amendment shall be $281,340.00, plus $5,000.00 for the NEPA document and establishes a contingency of 15% ($42,201.).

BE IT FURTHER RESOLVED that the Council authorizes the Department of Administrative Services to pay claims from Account #8403.

BE IT FURTHER RESOLVED that the Council additionally authorizes the Department of Administrative Services to transfer $25,000 from the Utilities Wastewater Account # 7113 to Account # 8403, to be utilized for the design of wastewater irrigation piping.
