RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING, ON APPEAL, A MODIFICATION OF THE TENTATIVE MAP CONDITION FOR THE BELLEVUE RANCH SUBDIVISION RELATING TO THE CITY'S HOUSING ALLOCATION PLAN REQUIREMENTS - FILE NUMBER MAJ95-0034

WHEREAS, the Planning Commission of the City of Santa Rosa received a request to modify the Tentative Map condition for the Bellevue Ranch Subdivision relating to the subdivision's compliance with the requirements of the City's Housing Allocation Plan; and

WHEREAS, Bellevue Ranch Partnership and Bellevue Ranch Associates, the subdividers, requested that an alternate method for complying with Housing Allocation Plan requirements be permitted for the subdivision, as outlined in a proposed Bellevue Ranch Housing Agreement; and,

WHEREAS, after a public hearing, the Planning Commission denied the request to modify the Tentative Map condition; and

WHEREAS, the subdividers appealed the Planning Commission's decision to the City Council; and

WHEREAS, the Council heard the appeal and did consider the requested Tentative Map modification, the proposed agreement, the staff reports, public comments, minutes, and the previous environmental determination for the development, at public hearings heldon March 16, 1999 and April 13, 1999; and

WHEREAS, the Bellevue Ranch Housing Agreement was revised to provide ownership housing for low income households in accordance with the Council's directions.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa hereby finds that the proposal contained in the revised Bellevue Ranch Housing Agreement constitutes an innovative approach to providing affordable housing and meets the objectives of the Housing Allocation Plan in that the proposal will provide an estimated 54 for-sale residential units for low-income households, as set forth in the agreement. As such, the proposal complies with the requirements of the Housing Allocation Plan asset forth in Section 21-02.122 of the Santa Rosa City Code. The Council further finds that the proposal does not change or affect the previous environmental findings and determinations made and approved with regard to the subdivision.

BE IT FURTHER RESOLVED that the Council hereby modifies Condition No. 1 of Planning Commission Resolution No. 8768, which approved the Tentative Map for the Bellevue Ranch Subdivision, by amending Planning condition number 1 of the Development Advisory Committee Report, dated May 15, 1995, for the Bellevue Ranch Subdivision, to read in full as follows:

"1. Final maps for Phases 1 through 4 of the Bellevue Ranch Subdivision shall comply with the requirements of the City's Housing Allocation Plan ("HAP") by the subdividers thereof executing that certain agreement entitled, "Bellevue Ranch Housing Agreement" ("Agreement"), as approved by the City Council, and thereafter timely fulfilling their obligations under the Agreement. Bellevue Ranch Subdivision Phase 5, the last phase of the subdivision, is a Parcel Map which divides Lot No. 174, as shown on the Phase 1 final map, into two lots, one of which is part of the "Allocated Unit Property" identified in the Agreement and will be used for allocated housing under the Agreement and the second of which is to be used for commercial purposes and as such is not subject to the Housing Allocation Plan. All property designated as "Allocated Unit Property" under the Agreement shall be subject to the requirements of HAP if that property is not utilized entirely for allocated units in accordance with the Agreement."

BE IT FURTHER RESOLVED that the appeal of the Planning Commission's denial of the Tentative Map modification is granted as herein set forth.
