Relief of Bidder and Bid Award - Repairs and generating facilities at Pump Station S-1

RESOLUTION NO. 23908

RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA RELIEVING DEAN BOLD CORPORATION OF ITS BID AND ACCEPTING BID AND AWARDING CONTRACT NO. 98-834 TO PACIFIC MECHANICAL CORPORATION FOR REPAIRS AND GENERATING FACILITIES AT PUMP STATION S-1

WHEREAS, bids have been invited for the performance of work for the City of Santa Rosa, generally described as Repairs and Generating Facilities at Pump Station S-1, Contract Number 98-834; and

WHEREAS, bids were received and opened in accordance with law and the City Engineer has reported thereon; and

WHEREAS, the apparent low bidder, Dean Bold Corporation of Petaluma, California, requested relief from its bid due to a clerical error, and has provided evidence demonstrating that the error was clerical in nature and made the bid materially different from the intended amount; and

WHEREAS, Pacific Mechanical Corporation of Concord is the second low bidder.

NOW, THEREFORE, IT IS RESOLVED, that the Council relieves Dean Bold Corporation of its bid and orders return of the bid bond.

IT IS FURTHER RESOLVED that the Council accepts the bid and awards Contract Number 98-834 to Pacific Mechanical Corporation in the amount $552,000 for performance in accordance with the plans and specifications on file in the office of the City Engineer.

IT IS FURTHER RESOLVED that the amount of Account 7857, Fountaingrove S1 & S2 Structural Repair be increased by $187,600, the source of funds to be Account 8624, Stand-by Generators for Water Pump Stations.

IT IS FURTHER RESOLVED that the Mayor is authorized to execute the contract and the Director of Administrative Services is authorized to pay all proper claims for performance of the contract from Account 7857.

IT IS FURTHER RESOLVED that in accordance with City Council Policy No. 100-07, "Authorization of Contract Change Orders on Public Works Contracts," the total authorized contract amount, including ten percent contingency, is $607,200.
