RESOLUTION NO. 23861

RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING AND ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE PROPOSED VISTA SONOMA SENIOR CITIZEN APARTMENT PROJECT, INCLUDING THE REZONING OF PROPERTY LOCATED AT 1401 TOWNVIEW AVENUE - FILE NO. REZ98-013

WHEREAS, the Environmental Coordinator completed an Initial Study on the possible environmental consequences of the proposed Vista Sonoma Senior Citizen Apartment project to be situated at 1401Townview Avenue (APN 014-691-003), including a rezoning to the R-3-30 (Multi-Family Residential) District, which study is dated November 19, 1998 and is on file in the Department of Community Development; and

WHEREAS, the study did not identify any significant effects on the environment which would result from the proposed project provided the mitigation measures therein identified and listed were implemented; and

WHEREAS, the Environmental Coordinator prepared a Mitigation Monitoring Program for implementation of the mitigation measures identified in the Initial Study, which program is on file in the Department of Community Development; and

WHEREAS, the Environmental Coordinator, based upon the Initial Study, prepared a proposed Mitigated Negative Declaration, subject to the implementation of the mitigation measures; and

WHEREAS, a notice of the proposed use of a Mitigated Negative Declaration for the project was posted and given and comments from the public and interested persons were invited; and

WHEREAS, a noticed public hearing on the proposed use of the Mitigated Negative Declaration for the project was held before the Planning Commission on December, 10, 1998, following which the Planning Commission recommended that the Council adopt the Mitigated Negative Declaration; and

WHEREAS, the Deer Run Homeowners Association filed an appeal of the Planning Commission recommendation, which was considered by the Council at a hearing on February 2, 1999; and

WHEREAS, the Council has reviewed and considered the Initial Study for the project, the findings and determinations of the Environmental Coordinator, the proposed Mitigated Negative Declaration, the Mitigation Monitoring Program, the written comments thereon received during the public review period, the oral and written comments, statements, and other evidence presented by all persons, including members of the public and staff members, who appeared and addressed the Planning Commission at its public hearing, the applicable portions of the staff report to the Council on the Mitigated Negative Declaration, and the appeal of the Planning Commission's recommendation thereon.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa, based on the comments, materials and testimony received during the noticed public review period for the proposed use of the Mitigated Negative Declaration and the records and files before the Planning Commission at its public hearing and the staff report to the City Council, adopts and incorporates by this reference the findings of the Environmental Coordinator in the Initial Study, dated November 19, 1998 which findings are on file in the Department of Community Development and confirms the determination of the Environmental Coordinator with respect to the proposed project.

BE IT FURTHER RESOLVED that the Council, based on the proposed Mitigated Negative Declaration, including the Initial Study, the comments and materials received during the public review period, including those presented at the public hearing held by the Planning Commission on the proposed use of the Mitigated Negative Declaration for this project and the staff report to the City Council, finds that there is no substantial evidence that the project will have a significant impact on the environment if the identified mitigation measures set forth in the Initial Study are implemented. The Council further finds and determines that the proposed Mitigated Negative Declaration, including the Initial Study, reflects the Council's independent judgment and analysis.

BE IT FURTHER RESOLVED that the Council, based on the above findings and determinations, hereby approves and adopts the Mitigated Negative Declaration for the project, adopts the mitigation measures identified in the Initial Study and the Mitigation Monitoring Program, and directs City staff to implement the program. The Initial Study and related materials, the Mitigated Negative Declaration and comments received during the public review period and other materials which constituted the record of proceedings upon which the decision is based are in the custody of the City's Director of Community Development and are located in the Department of Community Development, City Hall,100 Santa Rosa Avenue, Santa Rosa.

BE IT FURTHER RESOLVED that the appeal of the Planning Commission's recommendation on the use of the Mitigated Negative Declaration for this project is denied based on the above findings and determinations.
