ORDINANCE NO. 3803
ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA ESTABLISHING SALARY AND OTHER COMPENSATION AND BENEFITS FOR THE CITY ATTORNEY
THE PEOPLE OF THE CITY OF SANTA ROSA DO ENACT AS FOLLOWS:
Section 1. Effective December 31, 2006, salary compensation shall be paid to the City Attorney at the rate of $13,975 per month.
Section 2. The City Attorney's benefits, except as provided in this ordinance, shall be as provided in the contract between the City of Santa Rosa and the City Attorney dated November 21, 2006, a copy of which is attached hereto. The City Attorney shall be compensated in accordance with the established payroll practices of the City.
Section 3. The City will continue to contribute an amount equal to two percent (2%) of the City Attorney's salary per pay period into a Deferred Compensation Program.
Section 4. Effective July 9, 2006, the City shall pay an amount equal to five percent of the City Attorney's salary as set forth in Section 1, to the California Public Employees Retirement System (PERS) as an employer payment of a portion of the normal PERS employee contribution to PERS. The payments shall be reported to PERS as a percent (value) of compensation earnable (excluding Government Code section 20636(c)(4) as additional compensation.
Section 5. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.
Section 6. This ordinance shall become effective on the 31st day following its adoption and publication.
