ORDINANCE NO. 3750

ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING SECTION 20-20.020 ZONING MAP AND ZONING DISTRICTS, SECTION 20-23.040 THROUGH 20-23.060, AND SECTION 20-70.020 SANTA ROSA CITY CODE, TITLE 20-ENTITLED ZONING, FILE ST05-002

THE PEOPLE OF THE CITY OF SANTA ROSA DO ENACT AS FOLLOWS:

Section 1.  The Sections 20-20.020 (Zoning Map and Zoning Districts), Section 20-23.040 through 20-23.060 (Development and District Standards), and section 20-70.020 (Definitions) of the existing Santa Rosa City Code, Title 20, entitled Zoning does not appropriately address the process for development in the CD – Commercial Downtown zoning district and was therefore recommended by the Planning Commission on August 25, 2005 to be amended as contained in the Exhibit A, except that the following sections shall be revised:

Section 20-23.060 B.2.c shall read: Proposed utility equipment, i.e., meters, valves, transformers, splice boxes and other similar equipment shall:

(1) Be placed underground in vaults; or
(2) Be located within areas inside buildings designated for mechanical equipment and which is accessible for inspection and testing by City personnel, unless an alternative is specifically authorized by both the Design Review Board and the Director of Utilities.

Section 20-23.060 B.2.d shall read: "Open space areas may be incorporated into any proposal. Outdoor plazas, entry gardens, courtyards and landscape areas should be clearly defined. These areas should be designed so that they:

(1) May serve useful public or social purposes, with varied seating spaces, features of special interest including public art or fountains, and oriented to central areas and the primary walking corridors, including building entry areas and the adjoining sidewalk;
(2) Are located either at street level, or no more than five feet below the street level, occupy the majority of the perimeter adjacent to the street and sidewalk, and are accessible from the sidewalk.

Section 2.  The Section 20-20.020 (Zoning Map and Zoning District Standards) of the existing Santa Rosa City Code, Title 20, entitled Zoning does not appropriately address the locations for development in the CD – Commercial Downtown zoning districts and was therefore recommended by the Planning Commission on August 25, 2005 to be amended as contained in the Exhibit B except that:

Assessor Parcel Numbers 010-066-015, -016, and -017 shall be zoned to the CD-10 zoning district; and
 
Any application for Conditional Use Permit and/or Design Review which is located on Assessor Parcel Numbers 010-166-003 or -004 and is submitted and deemed complete prior to October 4, 2006 may be processed under the Zoning Code in effect on October 4, 2005 and in accordance with the standards for the CD- H zoning district.

Section 3Severability.  If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.

Section 4Effective Date.  This ordinance shall take effect on the 31st day following its adoption.
