ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING CHAPTER 20 OF THE SANTA ROSA CITY CODE- RECLASSIFICATION OF PROPERTY LOCATED AT 2780 STONY POINT ROAD (BELLEVUE PLAZA) - FILE NUMBER MNP00-002
THE PEOPLE OF THE CITY OF SANTA ROSA DO ENACT AS FOLLOWS:
Section 1. The Council finds, based on the evidence and records presented, that planned community ("PC") treatment is appropriate,and that the reclassification to the District is appropriate for the property identified in Section 3, due to subject property's physicalconfiguration and its location adjacent to established development.
The Council further finds and determines that the revision of the Bellevue Ranch Planned Community zoning district PolicyStatement as it relates to the subject site is consistent with the Santa Rosa General Plan in that:
1. The zoning authorizes a mix of commercial, residential, and other land uses in conformance with the Land Use Element of theCity's General Plan which designates the site for a neighborhood commons.
2. Adequate City services can be provided for the proposed development.
The Council has reviewed and considered the initial study for this project and the approved and certified Southwest Area PlanEnvironmental Impact Report (EIR), a master EIR, and determines that this reclassification is within the scope of the certified EIR. Inthis regard, the Council adopts and, by reference, incorporates herein the findings of the Planning Commission set forth inResolution No. 9959.
Section 2. On July 10, 2001, the Council adopted Ordinance No. 3256. Ordinance No. 3256 applies to parcel of real propertyidentified in Section 3 of this Ordinance.
Section 3. All conditions required by law having been satisfied and all findings with relation thereto having been made, Chapter 20 of the Santa Rosa City Code is amended by amending the "Zoning Map of the City of Santa Rosa," as described in Section 20-01.010,so as to change the classification of Assessor's Parcel Number 134-310-065 to the PC District: all development of this parcel shallbe subject to the provisions of Ordinance No. 3256, (requirements for lower-income housing), as the same now exists or may beextended and as its provisions may be amended, revised or reenacted in the future.
The Development Plan dated October, 1994, and the Policy Statement dated August 7, 2001, which are on file in the Department ofCommunity Development, are approved and shall govern all development of the property.
Section 4. This ordinance shall take effect the 31st day following its adoption.
