PUBLIC HEARING – TENTATIVE MAP AND CONDITIONAL USE PERMIT – NORTH VILLAGE II – 2406 FULTON ROAD – Application to subdivide an existing 17.89 acre parcel into 70 lots to accommodate the construction of 120 residential dwelling units proposed as single family and multi-family units, an onsite community center, and private open space. This review includes a Supplemental Environmental Impact Report (EIR) prepared to analyze changes in both the project and state law since the original NWSR 3-97 Annexation EIR was adopted – File Number MJP07-003.

City Planner, Noah Housh gave the staff report.
Hugh Futrell, applicant gave a presentation.
Bill Mastick, the applicant architect, gave a presentation.
Hugh Futrell continued his presentation of the community center.
There were questions concerning the use of the community center being available for Recreation and Parks, the HAP policy, setbacks from the houses on the north and statements of overriding consideration on the EIR.

Commissioner Byrd asked if Noah will discuss the project alternatives from the adopted EIR.
Commissioner Cisco asked for clarification with regards to the HAP policy.
Commissioner discussion ensued:
Commissioner Duggan – likes a lot of components to this project; would be interested into adding to the CC&R’s to insure that the recreation center could be used by the recreation and parks department; however does not like the units facing the 8-ft fence and the multi-family building and two units on the south property line that face the back of the North Village II building.
Commissioner Byrd – likes a lot of components to the project; feels that the wetland preservations could be a little better; he is concerned regarding the significant unavoidable impacts with regards to the original EIR.
Molly Dillon addressed his concerns about the EIR stating that they are not required to make statements of overriding consideration for the supplemental EIR as those have already been made when the previous discretionary approvals, the annexation and other portions of the project, were adopted.
Commissioner Poulsen added that there he remembered that there was an agreement to supplement fire and police and that agreement was made to help with the various issues as well as the infrastructure to be in place to override.
Noah Housh confirmed Commissioner Poulsen’s statement and added that the tools that were created since the EIR was done means that now they have the mechanisms in place to help offset those costs of police services that weren’t there when the original EIR was adopted which means the impact to police services is now less than significant.
Commissioner Stanley – stated it is an excellent project; likes how HAP was dealt with.
Commissioner Bañuelos – also likes the preservation of wetlands and is satisfied with the HAP; likes the park and community center but would like to see it remain open for the public. And, although she has some concern of the fence; and parking with the narrow streets; will support.
Commissioner Poulsen – likes the project, likes the alley design; likes the park; likes the connectivity; green design homes standards;
Commissioner Cisco – likes the project; likes the preservation of wetlands;
Hugh Futrell addressed concerns of wall/fence and stated it would be landscaped, he also stated if they required a condition of a minimum 20-ft setback they would accommodate that as well as the community center being available for Recreation and Parks as long as it was written carefully.
Commissioner Poulsen made a motion and Commissioner Duggan seconded to approve Resolution 11569: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ROSA ADOPTING A SUPPLEMENT TO THE NORTHWEST SANTA ROSA 3-97 ANNEXATION ENVIRONMENTAL IMPACT REPORT (SCH#2003022085) AND THE ASSOCIATED SUPPLEMENTAL MITIGATION MONITORING PLAN FOR THE NORTH VILLAGE II RESIDENTIAL SUBDIVISION – FILE NUMBER MJP07-003
