9.         CONSENT ITEMS:

 9.1       REQUEST FROM THE JOHN STEWART COMPANY TO APPROVE EXTENSION OF THE DEADLINE FROM DECEMBER 1, 2010 TO APRIL 1, 2011 TO SUBMIT A NEW APPLICATION FOR RAILROAD SQUARE AFFORDABLE HOUSING (2 FOURTH STREET) 

BACKGROUND:   On September 16, 2010, The John Stewart Company (JSCO) requested an extension of the construction timeline for Railroad Square Affordable Housing (the Project), a 68-unit affordable rental complex being developed at 2 Fourth Street as part of the New Railroad Square mixed-use development.  The delay in the Project's timeline is due to changes in the overall mixed-use development plan, including a proposed relocation of the affordable housing from the center block of the Sonoma-Marin Area Rail Transit (SMART) parcel to the adjacent Canners project parcel at 3 West Third Street.  Although the Canners site is part of the overall mixed use development, it is not part of the SMART site, therefore JSCO is seeking approval from SMART that the development of the affordable housing on the Canners site will satisfy SMART's affordable housing requirements.  On September 27, 2010, the Housing Authority moved to postpone consideration of JSCO's request to extend the Project's construction timeline, subject to receipt of a new application to the Housing Authority to be submitted to staff no later than December 1, 2010.  In a letter dated November 2, 2010, JSCO has indicated that it has not yet received SMART's approval that moving the affordable housing to the Canners site will satisfy SMART's affordable housing requirements.  Therefore JSCO is requesting an extension of the deadline to April 1, 2010 to submit a new Housing Authority application to staff. 

          RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority, by motion, approve an extension of the deadline to submit a new application for Railroad Square Affordable Housing, located at 2 Fourth Street, from December 1, 2010 to April 1, 2011.   

9.2       REQUEST FROM PETALUMA ECUMENICAL PROPERTIES (PEP HOUSING) TO RESCIND THE REMAINING FUNDING COMMITMENT IN THE AMOUNT OF $40,000 FOR CREEKSIDE VILLAGE SENIOR COMMUNITY (2323 MONTGOMERY DRIVE) 

BACKGROUND:  The Housing Authority approved two funding commitments for Creekside Village Senior Community, a 25-unit senior affordable rental housing development proposed for 2323 Montgomery Drive, in the amounts of $40,000 (July 2005) and $150,000 (May 2006).  In June 2008, due to delays in the development timeline of the adjacent market-rate project planned by Barry Swenson Builder (Swenson), which in turn delayed the development of PEP Housing's project, the Housing Authority approved an extension of PEP Housing's construction timeline.  Additionally, in consideration of the postponed timeline, the Housing Authority approved PEP Housing's request to rescind the second funding commitment of $150,000, leaving a remaining funding commitment of $40,000.  Currently, PEP Housing is requesting that the remaining funding commitment be rescinded, due to the fact that the agreement between Swenson and PEP Housing has now expired.

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority approve, by resolution, a request from Petaluma Ecumenical Properties (PEP Housing) to rescind the remaining funding commitment in the amount of $40,000 for Creekside Village Senior Community, a 25-unit senior affordable rental housing development proposed for 2323 Montgomery Drive.

9.3 REQUEST TO APPROVE AN EXTENSION OF THE CONSTRUCTION COMMENCEMENT AND COMPLETION DATES FOR HUMBOLDT APARTMENTS LOCATED AT 499 HUMBOLDT STREET AND 670 7TH STREET

BACKGROUND:  Humboldt Apartments, L.P. (Humboldt) is developing Humboldt Apartments a 51-unit, multifamily rental project.  To date, the Housing Authority has provided the project with $1,122,000 in funds.  Humboldt is requesting an extension of the construction commencement date of December 31, 2010 to June 30, 2011 and an extension of the completion date of September 30, 2011 to June 30, 2012 in order to restructure the financing for the project.

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority, by resolution, approve the extension of the construction commencement date for Humboldt Apartments located at 499 Humboldt Street and 670 7th Street, from December 31, 2010 to June 30, 2011 and approve the extension of the construction completion date from September 30, 2011 to June 30, 2012.

9.4       REQUEST TO APPROVE THE EXTENSION OF THE CONSTRUCTION COMMENCEMENT AND COMPLETION DATES FOR ACACIA LANE SENIOR APARTMENTS LOCATED AT 657 ACACIA LANE 

BACKGROUND:   Petaluma Ecumenical Properties (PEP) is requesting approval of extensions to the construction commencement and completion dates for Acacia Lane Senior Apartments, a 44-unit, senior rental complex located at 657 Acacia Lane.  PEP is requesting an extension of the construction commencment date from November 30, 2010 to April 1, 2011.  The delay is due to the closing of the various funding sources being used to construct the project, which include HUD 202 funds, bond funds, and tax credits.  The extension of the construction commencement date necessitates an extension of the construction completion date from February 29, 2012 to June 30, 2012.  

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority, by resolution, approve the extension of the construction commencement date for Acacia Lane Senior Apartments, located at 657 Acacia Lane, from November 30, 2010 to April 1, 2011 and approve an extension of the construction completion date from February 29, 2012 to June 30, 2012.

9.5       REQUEST TO APPROVE THE SALE OF SURPLUS MITIGATION CREDITS FROM THE CROSSROADS PROJECT LOCATED AT 1980-2010 BURBANK AVENUE TO AMOROSA VILLAGE I AND II AND CATALINA HOMES LOCATED AT DUTTON MEADOW AND TUXHORN DRIVE

BACKGROUND:   Burbank Housing Development Corporation (BHDC) requests approval to sell mitigation credits purchased by the Crossroads development to Amorosa Village I and II and Catalina Homes (Dutton Village), which are in need of mitigation credits due to the construction of underground utilities on Dutton Meadow and the installation of a traffic signal at the intersection of Dutton Meadow and Hearn Avenue, which was not included in the original Section 404 Permit issued by the U.S. Army Corps of Engineers.  In order to proceed with the improvements, BHDC needs to purchase up to 0.5 acres of California Tiger Salamander credits from the Crossroads for approximately $50,000.  A recorded Security Agreement between the Housing Authority and BHDC allows this option to be exercised.

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority, by resolution, approve the sale of California Tiger Salamander mitigation credits from the Crossroads to Amorosa Village I and II and Catalina Homes.

10.       SCHEDULED ITEMS:

10.1     REQUEST FROM COMMUNITY HOUSING SONOMA COUNTY FOR A FURTHER ADVANCE OF $40,000 FOR THE ACQUISITION AND DEVELOPMENT OF AN EXISTING FOUR-PLEX APARTMENT BUILDING LOCATED AT 1228 MCMINN AVENUE

BACKGROUND:  On July 29, 2010, the Housing Authority approved a conditional reservation of funds in the amount of $430,191 to Community Housing Sonoma County (CHSC) for the acquisition and development of 1228 McMinn Avenue (McMinn Avenue), an existing apartment building with four (4) two-bedroom units, located in the City’s Neighborhood Revitalization Program (NRP) “Sunset-Delport” target area.  On August 12, 2010, CHSC and the Housing Authority executed loan documents, formally committing funds, including a Regulatory Agreement which secures affordability of the four (4) units to households at or below fifty percent (50%) of median income for a term of twenty (20) years.  CHSC, in collaboration with Sonoma County Mental Health Division (SCMHD), proposes to acquire the McMinn Avenue property and develop the first Mental Health Services Act (MHSA) shared housing project in Sonoma County.  CHSC will acquire and rehabilitate the property for use as permanent supportive housing for eight (8) MHSA target population adults who are homeless or at risk of homelessness and have a psychiatric disability.  In addition to the Housing Authority, CHSC has applied to the California Housing Finance Agency (CalHFA) for MHSA funding in the amount of $595,500 and the Federal Home Loan Bank of San Francisco for Affordable Housing Program (AHP) funding in the amount of $80,000.  CalHFA staff has indicated that they will not release any MHSA funds for acquisition until all other financing is committed.  If McMinn Avenue does not receive a commitment of AHP funds in December, CHSC will not be able to close escrow before the purchase agreement deadline of December 31, 2010.  CHSC is requesting a further advance of $40,000 as contingency funding and will defer $40,000 of its $85,000 developer fee to back-fill the AHP amount of $80,000.

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority, by resolution, approve a further advance in the amount of $40,000 to Community Housing Sonoma County for the acquisition and development of 1228 McMinn Avenue for use as permanent supportive housing for adults who are homeless or at risk of homelessness and have a psychiatric disability.

10.2    REPORT OF NOMINATING COMMITTEE AND ELECTION OF OFFICERS

BACKGROUND:  At the October 25, 2010 Housing Authority meeting, a Nominating Committee was appointed consisting of Vice-Chairman Evans and Commissioner Arnone.  At the Housing Authority’s Annual Meeting, being held November 22, 2010, the Nominating Committee will give its report and recommendation for Chairman and Vice-Chairman of the Housing Authority for the upcoming year.

RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Housing Authority hear the report of the Nominating Committee and that it entertain a motion electing a Chairman and Vice-Chairman for the next calendar year, with the term of office commencing January 1, 2011.
