This resolution authorizes an increase of the Luther Burbank Home & Gardens reserve trust fund of $10,000 due to the grant award program, McCormick Salutes America's Flavor Landmarks, from McCormick and Company, Inc.
10.2 RESOLUTIONS – MEASURE M COOPERATIVE AGREEMENTS
These four resolutions, recommended by the Public Works Department, approve and authorize execution of the Cooperative Agreements with the Sonoma County Transportation Authority in order to obtain Measure M funds for Farmers Lane Extension, Hearn Avenue Improvements, Road Maintenance, Intelligent Transportation System implementation and Santa Rosa Creek Trail and appropriate funds for Fiscal Year 2005/06 for Farmers Lane Extension, Hearn Avenue Improvements and Santa Rosa Creek Trail – Streamside Drive to Mission Boulevard multi-use path.
10.3 RESOLUTION – WEST STEELE LANE WIDENING – MARLOW ROAD TO COFFEY LANE
This resolution, recommended by the Public Works Department, awards construction Contract No. 2003-010, West Steele Lane Widening – Marlow Road to Coffey Lane in the total amount of $3,339,337.00 to the lowest responsible bidder, Argonaut Constructors of Santa Rosa, California, and authorizes the transfer of $225,000 from Account No. 7565, WM Replace: Jennings - Range to Cleveland, to Account No. 7884, WM Replace: W. Steele Lane Reconstruction.
This resolution, recommended by the Public Works Department, authorizes the Director of Public Works to submit a grant application to the California Department of Transportation requesting $110,000 from the Community Based Transportation Planning Grant Program to complete the transportation element of the Citywide Creek Master Plan and, if approved, to execute a funding agreement and establish a project budget.
10.6 ORDINANCE ADOPTION – REZONING – CONGREGATION BETH AMI, 4676-4678 MAYETTE AVENUE
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, rezones 4.8 acres situated at 4676-78 Mayette Avenue to the R-1-6 (Single-family Residential) District.
10.7 ORDINANCE ADOPTION – RECLASSIFICATION – 5815 MELITA ROAD
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, rezones the property at 5815 Melita Road to the RR-20-SR (Rural Residential, Scenic Roadway) District.
10.8 ORDINANCE ADOPTION – SUMMER 2005 GENERAL PLAN AMENDMENT – 1615 FULTON ROAD
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, rezones the property at 1615 Fulton Road to the R-1-6 (Single Family Residential) District.
10.9 ORDINANCE ADOPTION – SUMMER 2005 GENERAL PLAN AMENDMENT – 3745 AIRWAY DRIVE
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, rezones the property at 3745 Airway Drive to the CG (General Commercial) District.
10.10 ORDINANCE ADOPTION – SUMMER 2005 GENERAL PLAN AMENDMENT – 4771 AND 4775 SONOMA HIGHWAY
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, prezones 3 acres located at 4771 and 4775 Sonoma Highway to the R-1-6 (Single Family Residential) and CG (General Commercial) Districts.
10.11 ORDINANCE ADOPTION – SUMMER 2005 GENERAL PLAN AMENDMENT – 6525 AND 6535 OAKMONT DRIVE
This ordinance, introduced at the August 9, 2005 Regular Council Meeting, rezones the property at 6525 and 6535 Oakmont Drive to the CG (General Commercial), R-3-18 (Multiple Family Residential) and R-1-6 (Single Family Residential) Districts.
11. REPORT ITEMS
11.1 REPORT – SUMMARY VACATION OF EXCESS RIGHT-OF-WAY LOCATED AT 2985 WILJAN COURT
BACKGROUND: Wiljan Court was originally planned as a cul-de-sac, with right of way dedication and easements established at the time of subdivision approval. The street has since been connected to Dowd Drive and the excess right-of-way that was reserved for the cul-de-sac is no longer needed. The applicant proposes a summary vacation and relocation of existing public utility and sidewalk easements. The area to be vacated is located on the west side of Wiljan Court and is divided into two halves, each with a separate property owner. The application for summary vacation concerns the northwestern portion of the planned cul-de-sac, as shown on the Summary Vacation exhibit to the staff report. The summary vacation for the southwestern portion will be processed with a separate application.
RECOMMENDATION: The Department of Community Development recommends that the Council adopt a resolution approving the summary vacation of excess right-of-way located at 2985 Wiljan Court.

11.2 PUBLIC HEARING – REZONING – CAMDEN PLACE – 2700 MARLOW ROAD
BACKGROUND: Rivendale Homes is proposing to develop a 2.64 acre site at 2700 Marlow Road on the Southeast corner of Marlow Road and W. Steele Lane. To develop the site requires a rezoning of the property from a PD (Planned Unit Development) to the R-1-6 District. The Planning Commission unanimously approved a tentative map that permits the subdivision of the site into 16 lots for 12 single family detached residences and 4 duplexes (20 units) and approved a conditional use permit for a residential small lot project all subject to the necessary rezoning. The General Plan designates the site low density residential which allows densities up to 8 units per acre; this project offers a density of 7.6 units per acre.
RECOMMENDATION: The Planning Commission recommends that the Council, by resolution, adopt a mitigated negative declaration for the project and introduce an ordinance rezoning the site to the R-1-6 District.
